Track the History - Us Taken-Away Kids: commemorating the 10th anniversary of the 'Bringing them home' report
This timeline focuses on one particular aspect of the history of Aboriginal and Torres Strait Islander peoples - the forcible removal of Indigenous children from their families. This material identifies some significant laws and practices that made removal lawful and includes writing and artwork from members of the Stolen Generations and their families which illustrate their experiences of these policies. Native Title Report 2001: Chapter One: The Right to Negotiate and Human Rights
The 'right to negotiate' is a fundamental right assured by the Commonwealth Native Title Act (the 'NTA') and reflected in international human rights standards. Yet in practice the capacity of native title parties to exercise their 'right to negotiate' is determined by factors other than the mere existence of the right. Given the primary role of state and territory governments in land administration, their policies regarding the administration of the right to negotiate have a significant impact on native title parties' capacity to exercise their 'right to negotiate'. -

I call my paper 'Social Justice Then Native Title' in order to make a clear distinction between two aspects of Indigenous People's struggle; the ultimate goals we are seeking to achieve and the means by which we seek to achieve them. Distinguishing the means and the ends, the former a servant of the latter, is a fundamental tenet of strategic thinking. And it is clear to me that a strategic approach will identify native title as simply a tool for achieving social justice for Indigenous people. -
