By this instrument, the Human Rights and Equal Opportunity Commission (‘the Commission') grants a temporary exemption to Regional Express (“REX”) pursuant to section 55(1) of the Disability Discrimination Act 1992 (Cth) in relation to airline services operated by REX.

By this instrument, the Australian Human Rights Commission (‘the Commission’) rejects the application of Village Roadshow Limited, Amalgamated Holdings Ltd trading as Greater Union Cinemas, Event Cinemas and Birch Carroll & Coyle, Reading Cinemas Pty Limited and The Hoyts Corporation Pty Limited (the Applicants) for a temporary exemption pursuant to s 55(1) of the Disability Discrimination Act 1992 (Cth) (DDA). SUMMARY

The Human Rights and Equal Opportunity Commission has received an application under section 55 of the Disability Discrimination Act for a termporary exemption, for a period of 18 months, regarding disability access to bathroom facilities at a proposed bed and breakfast facility.

The DDA covers discrimination on the ground of disability, including discrimination because of the use of a therapeutic device or aid;1 accompaniment by a carer or assistant;2 or accompaniment by an assistance animal.3

Recommendation 1: The Commission recommends that the Australian Government fully incorporate into Australian law its human rights obligations to children, including through the adoption of a federal Human Rights Act.

A woman who uses a wheelchair complained that when she took her 11 year old nephew to a museum as part of an interstate family holiday, he was denied access to important parts of the collection on the basis of her disability. Children under 12 were required to be accompanied by an adult; access to some of the exhibits was not feasible for the complainant because of her disability; and the respondent had declined a request to permit the boy to be accompanied by a museum staff member instead.

I write to you concerning your application under section 55 of the Disability Discrimination Act 1992 (DDA) for a Temporary Exemption in relation to the provision of captioning and audio description.
