Recommendation for temporary exemption: S.A. Minister for Transport and Others
The Commission has previously granted a temporary exemption under section 55 of the Disability Discrimination Act 1992 (DDA) to the South Australian Minister for Transport, TransAdelaide and the South Australian Passenger Transport Board from the operation of section 24 of the DDA, specifically in relation to the lack of access for people who use a wheelchair to existing buses. -

We have a Prime Minister whose vision for us is to be relaxed and comfortable. At the international level there are three broad categories of obligation to which a state may be subject: treaty law, customary international law and emerging international standards. Treaty obligations become binding on states once they have ratified a treaty. This means that the state allows itself to be bound by the conditions and obligations contained within the treaty. Customary international law is enshrined in continuous practice by a majority of states over an extended period of time. -

I have called this paper "the right to belong", and it is with this idea that I wish to begin my address to you this afternoon, before discussing in more detail the current state of the law in relation to disability discrimination.
