Social Justice Report 2006: Chapter 4: International developments on the rights of indigenous peoples – Closing the ‘protection gap’
In recent years there have been significant developments at the international level that impact upon the recognition and protection of the human rights of indigenous peoples. Most notably, there have been: i) reforms to the machinery of the United Nations (UN) and the emphasis given to human rights within that system; ii) the making of global commitments to action, through the Millennium Development Goals (MDGs) and the Second International Decade of the World’s Indigenous People; and iii) the further elaboration of human rights standards as they apply to indigenous peoples. -

Presentation at the Governor’s Leadership Foundation Forum
HREOC is a statutory body independent of government. While our main function is to promote an understanding and acceptance of human rights in Australia, we are also charged with the responsibilities of investigating, and attempting to conciliate complaints of unlawful discrimination under the federal Racial Discrimination Act 1975, the Sex Discrimination Act 1984, the Disability Discrimination Act 1992 and the Age Discrimination Act 2004.1 HREOC also has specific responsibilities to report annually to Parliament on the enjoyment of human rights of Indigenous Australians. -

In Europe, assertions of individual rights evolved with the emergence of Nation-States. The Magna Carta, first issued in 1215, was an early legal document that granted certain rights to the English nobility by the King. The Magna Carta was reissued in different forms and reinterpreted in England over several centuries. Many of its rules were about the operation of feudal English society, though it influenced the development of rights in the common law. One of its most important innovations was the right of free men not to be imprisoned or punished except in accordance with the law. -

I would like to begin by acknowledging the Traditional Owners of this land, the Pambalong clan of the Awabakal people, and pay my respect to their elders, past and present. Today I would like to explore the question: ‘What does it mean to believe in human rights in Australia today?’ This is an ambitious project, and I am aware that the question does not have a short and simple answer. -

I will not speak in detail about human rights conventions and disability because this topic is addressed by my co-speaker in this session, Karl Lachwitz. I will say though that international human rights law and human rights debate has not yet acknowledged adequately or sufficiently clearly that people with a disability are part of what the "human" in human rights means. Equally, there has not always been enough attention to human rights dimensions in disability discourse. -
