The Commission is a national independent statutory body established under the Human Rights and Equal Opportunity Commission Act 1986. It has a President and five Commissioners. The five positions are currently held by three persons.

The current mandatory detention policy of the Commonwealth of Australia breaches the fundamental principle of the rights of the child which is that children should be able to develop to their full potential. The policy breaches every article of the Convention on the Rights of the Child. The policy violates the right to health as established by international law.

Australian law requires the detention of all non-citizens who are in Australia without a valid visa (unlawful non-citizens). This means that immigration officials have no choice but to detain persons who arrive without a visa (unauthorised arrivals), or persons who arrive with a visa and subsequently become unlawful because their visa has expired or been cancelled (authorised arrivals). The Tasmanian Government recognises the Federal Government's responsibilities for the management of immigration to Australia. During the last decade a policy of mandatory detention has been established for those who enter Australia without proper authority (an appropriate visa). A period of detention allows the Commonwealth Government to ensure that those unauthorised arrivals do not have a health status, character or criminal record of concern to the Government.
