Native Title Report 2003 : Chapter 4: Native Title and Agreement Making : a Comparative Study
The failure in Australia to perceive native title and land rights as the basis on which to address Indigenous economic and social development has been evident at legal, policy and administrative levels. Legally, the increasingly narrow interpretation of native title by the High Court has, as Noel Pearson has pointed out, stripped native title of much economic meaning or benefit. -

RESPONSE TO THE DISCUSSION PAPER: LIVING WILLS: OPASA
In South Australia, the general terms 'advance directive', or 'living will', usually refer to any written statement that expresses a person's wishes and/or directions whilst of sound mind (ie not mentally incapacitated*), in advance of any possible loss of decision making ability that may occur in the future. Of the advance directives made by South Australians, only the following are legally recognised and binding. -

Good house, good clinic and being able to buy a feed
Mick Dodson, the former Aboriginal and Torres Strait Islander Social Justice Commissioner said in his First Report that "A decent standard of health and a life expectancy equivalent to others is an entitlement. Social justice is not primarily a matter of the relief of suffering. It is a matter of the fulfilment of a responsibility. To draw this distinction is not to deny that the facts by themselves speak out for a remedy. Nor is it to deny that compassion is a proper response. But compassion is an insufficient foundation for the delivery of rights". -

Social Justice Report 2001: Chapter 5: Juvenile diversionary schemes and Indigenous people
On 27 July 2000, the Commonwealth government and the Northern Territory Government signed an agreement for the establishment of a juvenile pre-court diversion scheme in the Northern Territory (NT). This agreement arose specifically as a response to the continued criticism of the NT’s mandatory minimum imprisonment laws and their impact on juveniles and Indigenous people. By establishing the pre-court juvenile diversionary scheme, the NT has belatedly joined most other states and territories in Australia in providing such options for dealing with juvenile offenders. -

Disability discrimination legislation and its implementation (1997)
When I was invited to prepare this paper, Andrew Byrnes encouraged me to concentrate on drawing out strategic thoughts from the Australian experience which might be relevant in Hong Kong , and perhaps in other countries also.
