It has now been over two years since the federal government introduced new arrangements for the administration of Indigenous affairs. One of the catchcries of the new arrangements is that they are aimed at ‘harnessing the mainstream.’ This is to be achieved by removing or reducing the barriers that prevent Indigenous peoples from accessing existing mainstream services on an equitable basis. -

Where possible, the data is presented in a way that identifies absolute and relative change in the situation of Indigenous peoples over the past five and ten years, and provides some international comparisons. -

ADR as a tool for social change: a discussion (2008)
Human rights and anti-discrimination law in Australia, as in many countries in the Asia Pacific, provides for complaints about discrimination and violations of human rights to be resolved by conciliation. The use of Alternative Dispute Resolution (ADR) in this context has been criticised. In particular, it has been claimed that the individualised form of the complaint process, coupled with the confidential nature of conciliation outcomes, restricts the social reformative potential of human rights and anti-discrimination law. -

The SDA is amended to extend the prohibition of sexual harassment; allow for representative complaints; bring industrial awards under the act and introduce conciliation as a method for addressing victimisation. -

This working group was relatively small in size but very diverse and robust in its deliberations. In regard to the payment of $1 an hour. It's true there was no actual payment in cash terms but the equivalent rate of one point to one dollar allowed the detainees to purchase goods according to the number of points they had gained. I think it is a mere technicality and that, argued in a court of law, they were being paid for their assistance. The perception anyway from the detainees and ourselves was that they were being paid at the rate of $1 an hour. In one case that I know, a detainee teacher bought more than his points value in dollar terms. In his account he had some of his own money. -

That the federal Government request the Australian Bureau of Statistics (ABS) to provide to COAG information on the actions that need to be taken in order to improve Indigenous data collection. The ABS should respond to the suggestions made by the Steering Committee for the Review of Government Service Delivery in the Overcoming Indigenous Disadvantage Report 2003, as well as identify actions that they consider necessary to ensure the availability of relevant data on a regular basis. Thank you to Jon Altman and Boyd Hunter for the opportunity to speak at this important conference. It has provided an excellent opportunity for researchers, bureaucrats and policy-makers to discuss the adequacy of current collection methods for socio-economic data relating to Indigenous people, how such data might be improved and how it might be better utilised. -

Annual Report 06-07: Chapter 5 - Legal Services
The Human Rights and Equal Opportunity Commission Act gives HREOC the function of inquiring into complaints concerning breaches of human rights or discrimination in employment. HREOC attempts to resolve such complaints through conciliation where appropriate. If the matter is not resolved through conciliation and the President is satisfied that a breach of human rights or an act of discrimination has occurred, the President reports on the matter to the federal Attorney-General. -
