DR OZDOWSKI: I would like to formally open the second day of hearings in Adelaide. This is one of the hearings conducted around Australia for the National Inquiry into Children in Detention. My name is Sev Ozdowski, I'm the Human Rights Commissioner. With me is Mrs Robin Sullivan to my left, who is Queensland Children's Commissioner, and Dr Trang Thomas, on my right, is Professor of Psychology at the Royal Melbourne Institute of Technology. They are Assistant Commissioners helping me with the Inquiry. -

6. Australia's Immigration Detention Policy and Practice
Australian law requires the detention of all non-citizens who are in Australia without a valid visa (unlawful non-citizens). This means that immigration officials have no choice but to detain persons who arrive without a visa (unauthorised arrivals), or persons who arrive with a visa and subsequently become unlawful because their visa has expired or been cancelled (authorised arrivals). Australian law makes no distinction between the detention of adults and children. -

Launch of the Supreme Court Equal Treatment Benchbook
When I first entered the law 'benchbooks' were closely guarded, leather bound books into which judges carefully entered notes as a case progressed - usually I thought adverse comments and exclamation marks about one's arguments or less than flattering remarks about one's principal witness. These books seemed to be some kind of secret code to the outcome of cases and never saw the light of day. -

7. Refugee Status Determination for Children in Immigration Detention
The United Nations High Commissioner for Refugees (UNHCR) estimates that around half of the 50 million displaced persons in the world are children. Around 10 million of these children are under the care of UNHCR. Approximately 100,000 separated children roam Western Europe.(1) During 1999 alone, more than 20,000 separated children applied for asylum in Western Europe, North America or Australia.(2) Of those 20,000 unaccompanied children, 46 travelled to Australia to seek asylum. In the same year a further 202 children sought asylum in Australia with their families.(3) -

Speech - iPhone or Trombone: Age or Disability Don't Have to be Barriers (2012)
Alan used to work as a civil engineer, and is a trombone player with two orchestras and two bands. He has competed in the Australian Band Championships for the last three years. He sold his soils laboratory to 'retire', and has never looked back. He still works part-time in soil testing, but as well as trombone playing he is a volunteer in a Rotary shop, walks 30-40 kilometers weekly, won a silver medal in the 10 km Road Race in the Australian Masters Games 2012, and completed a novel for pre-teens called 'Alex', designed to raise awareness about healthy lifestyles. -

Governments that fail to do so are in breach of their obligations under the Convention on the Rights of the Child (CRoC), the International Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW) and the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD). -

Hastings: Transition
When I was discussing this event with Jenni Huon we talked about whether the theme should be "transition" or "transitions". At the time I thought it did not matter much, but as soon as I started to write this address I realised that I am going to talk about "transition". "Transitions" (plural) suggests one discrete thing after another, a beginning, middle and end before another beginning. It is a word describing things, separate events, bits of life that can be captured, have edges put round them. -

<h3>1.1 Introduction</h3> <p>In last year’s <i>Social Justice and Native Title Report</i>, I raised concerns about the changes resulting from the 2014-15 Budget and the restructure to Indigenous Affairs through the Indigenous Advancement Strategy (IAS).</p> <p>Despite initial concerns about how these changes would impact our communities, I indicated that the streamlining of programs and the move away from a ‘one size fits all’ mentality had the potential to offer great benefit and flexibility for Aboriginal and Torres Strait Islander peoples.</p> -
