The Integration of Customary Law into the Australian legal system
Good afternoon, I’d like to begin by acknowledging the Noongar people, the traditional owners and custodians of the land where we are gathered today, and pay my respects to their elders. I’d also like to acknowledge my distinguished fellow speakers. My presentation today is focused on customary law. I will refer to Aboriginal customary law, though the points that I will make are equally relevant to Torres Strait Islanders and to their distinct systems of law and governance. -

Good evening distinguished guests, my Indigenous brothers and sisters and non Indigenous friends. May I begin by acknowledging the Wurrundjeri People of the Kulin Nation on whose land we are meeting on tonight, and thank the dancers for cultural expression and your welcome to country. Thank you also to the Vice Chancellor, Professor Paul Johnson for your introduction, and to La Trobe University for inviting me to present this year’s Hyllus Maris Memorial Lecture. I also want to make mention of the fact that we are 130kn south west of an area of great significance to the Aboriginal communities of western NSW, which is now called Mutawintji National Park - the first park to be handed back to its Traditional Owners under the NSW National Parks and Wildlife Act in 1998. [1] The caves and overhangs in the park have been transformed into expansive galleries of Aboriginal rock art, and it comes as no surprise that they have formed the backdrop for ceremonies for at least 8,000 years. -

I accepted the invitation to make this Oration and come here tonight with some trepidation: The person being honoured tonight, Dame Roma Mitchell, was the first federal Human Rights Commissioner and this is the territory that has known the powers of persuasion, conviction and commitment of the best human rights minds in the country, including Dame Roma Mitchell herself. Yet I reminded myself that we are both cultivators in the same vineyard, albeit that I both lagged behind her and sought to learn from her. My work today is made easier by the clear and decisive path cut out by my predecessor. -

Prior to changes made by the Human Rights Legislation Amendment Act 1999 which took effect in April 2000, the Australian Human Rights Commission conducted hearings and made determinations on Disability Discrimination Act complaints referred to it by the Disability Discrimination Commissioner or delegate. Complaints were referred to the Commission because the complaint could not be settled by conciliation or because the nature of the matter was such that it should be determined by the Commission. -
