This submission is made by the Aboriginal and Torres Strait Islander Social Justice Commissioner on behalf of the Human Rights and Equal Opportunity Commission (HREOC) of Australia. In recent years the Commissioner has undertaken many activities relating to the rights of Indigenous children. This submission provides an overview of the inequality and discrimination faced by Aboriginal and Torres Strait Islander children in Australia, and key concerns in relation to the Convention on the Rights of the Child in addressing this. -

Indigenous Deaths in Custody: Part E Profiles: Indigenous Deaths in Custody 1989 - 1996
The deceased was serving a life sentence for murder, having been convicted on 26 April 1978. In April 1991 he was granted permission to attend the University of Tasmania to undertake a bridging course. The deceased signed an agreement which regulated his attendance at the course. He breached the agreement on 15 August 1991 when he left his authorised custodian and consumed alcohol. He was subsequently informed he would be returned to maximum security with a review of his current arrangements and classification. -

That article was published on the eve of Corroborree 2000 and the handing over to the people of Australia of the declaration towards reconciliation by the Council for Aboriginal Reconciliation. The poor health of Aboriginal and Torres Strait Islander peoples is no secret – and something can be done about it. Since 2006, Australia’s peak Indigenous and non- Indigenous health bodies, NGOs and human rights organisations have worked together to secure the support of Australian governments for a human rights based approach to achieving health and life expectation equality for Australia’s Aboriginal and Torres Strait Islander peoples. This is known as the Close the Gap Campaign. -

There is intense hurt and anger at being isolated on the basis of race and subjected to collective measures that would never be applied to other Australians. The Intervention was received with a sense of betrayal and disbelief. Resistance to its imposition undercut the potential effectiveness of its substantive measures. -

Bringing them Home - Chapter 20
There were a lot of families on the outside who were saying my daughter hasn't come home, my son hasn't come home. You had a lot of families still fighting and then you had the bloody welfare saying to these families, `We're not doing what was done in the sixties'. Bomaderry Home was left open as a big secret by the government and the welfare. And it must have been one of the best kept secrets that the Government kept. It was hard for the people on the outside to prove we was there when the government said we weren't. -
