I am very grateful for this opportunity to address this speech night. 1998 is an historic year. Not only does it mark the 130th anniversary of Brisbane Grammar School, the oldest secondary school in Brisbane, it also marks the 50th anniversary of the Universal Declaration of Human Rights. They are both significant anniversaries and they are tied together by the importance they place on the role of education to inform, instruct and inspire. -

I accepted the invitation to make this Oration and come here tonight with some trepidation: The person being honoured tonight, Dame Roma Mitchell, was the first federal Human Rights Commissioner and this is the territory that has known the powers of persuasion, conviction and commitment of the best human rights minds in the country, including Dame Roma Mitchell herself. Yet I reminded myself that we are both cultivators in the same vineyard, albeit that I both lagged behind her and sought to learn from her. My work today is made easier by the clear and decisive path cut out by my predecessor. -

I feel very honoured to have been invited to contribute to this symposium. As a theme for today's discussion, I have chosen the notions of regionalisation and responsibility within Asia and the Pacific. I believe that the ability to accept responsibility for our neighbourhood, and to generate cooperative regional dialogues and actions to fulfill that responsibility will be the key to meeting the challenges and opportunities human rights will face in the new century. -

To be honest, this is a rare occasion for me. Much of my career has been spent in the monastic cells of academic institutions teaching the young about different legal systems; their origins and growth, their strengths and weaknesses. Your world - the world of business and industry, finances, profit and loss, sales and marketing - is largely foreign to me in a practical sense. -

Ending family violence and abuse in Aboriginal and Torres Strait Islander communities – Key issues (2006)
Family violence and abuse is causing untold damage to the cultures and fabric of Indigenous societies. It is damaging our communities, our families, our women, our children and our men. All Indigenous people are entitled to live their lives in safety and full human dignity - without fear of intimidation, family violence or abuse. This is their cultural and their human right. Like all Australians, Indigenous peoples are also entitled to the full and equal protection of the law. -

Corporate Responsibility - Developing principles on Resource Development on Indigenous land: A Human Rights based approach
These Principles were developed by a forum of Indigenous people from Australia's major mineral resource regions, held in Alice Springs in May 2002. Participants had a depth of experience and expertise in areas across the country, but the process did not make any claim to represent a national Indigenous view. The forum was co-hosted by the Aboriginal and Torres Strait Islander Social Justice Commissioner (Dr Bill Jonas) and Professor Ciaran O'Faircheallaigh on behalf of Griffith University and facilitated by Indigenous lawyer, Robynne Quiggin. -

In 2001 Rhonda Kelly and Ciaran O'Faircheallaigh were commissioned by HREOC to undertake a report on Corporate Social Responsibility, Agreement Making and native title in Australia. Corporate Responsibility - Developing principles on Resource Development on Indigenous land: Human Rights Based Approach to Mining on Aboriginal Land
Human rights constitute the ethical basis of the social contract between those who exercise power and accrue wealth, and those whose lives are affected by this exercise and accrual. Where such a relationship has no ethical basis and is inconsistent with human rights principles it is not a sustainable relationship. Coercion may prolong it for some time but this is costly to maintain and eventually becomes exhausted. -

Corporate Responsibility - Developing principles on Resource Development on Indigenous land: Frameworks for Negotiation of Mining Agreements
This approach is based on acceptance by companies that they cannot continue to operate profitably over the longer term unless they can win support for their operations from the wider society, including Indigenous peoples. This means that companies may adopt certain policies and act in particular ways not because it makes money for them in the short term, or because they are legally required to do so, but because they believe that this will ensure support for their business activities in the wider community. -

Social Justice Report 1998 : Introduction: A Handful of Soil
The removal of the children from Wave Hill by MacRobertson Miller aircraft was accompanied by distressing scenes the like of which I wish never to experience again. The engines of the 'plane are not stopped at Wave Hill and the noise combined with the strangeness of an aircraft only accentuated the grief and fear of the children, resulting in near-hysteria in two of them. I am convinced that the news of my action at Wave Hill preceded me to other stations, resulting in the children being taken away prior to my arrival. -

It has been worth it because the wider community is more aware of the issues and our history, but the opening of the old scars has been difficult. It's vital that the truth comes out, though.
