The Australian Human Rights Commission (the Commission) makes this submission to the Senate Legal and Constitutional Affairs Committee in its inquiry into the Commonwealth Commissioner for Children and Young People Bill 2010. This submission considers the broad issues raised by the Bill. It does not make a detailed analysis of each proposed provision.

1. The Human Rights and Equal Opportunity Commission (HREOC) welcomes the Minister’s decision to appoint an independent Australian Citizenship Test Review Committee (the Committee) to consider the content and operation of the Australian citizenship test (the test) since its introduction in October 2007.

The Minister must, by written determination, approve a test for the purposes of subsection 21(2A) which examines whether the applicant has satisfied the general eligibility requirements set out in sections 21(2)(d), (e) and (f).

The Human Rights and Equal Opportunity Commission ('the Commission') has been invited by the Senate Legal and Constitutional Legislation Committee ('the Committee') to make submissions on the Australian Citizenship Bill ('the Bill'), which is intended to replace the Australian Citizenship Act 1948 (Cth) (the 'Citizenship Act')

At the hearing held 30 January 2006, the Commission took three questions on notice. I am advised that the answers to the Honourable Senators’ questions are as set out below.

The Commission commends the Government for recognising the importance of addressing the need to improve school enrolments and attendance as a critical step towards realising the right to education for all children. The Commission supports the Government’s aims to promote and protect children’s right to education.

The Human Rights and Equal Opportunity Commission (HREOC) which was established in 1986 by the Federal Parliament as successor to the 1981 Human Rights Commission is an independent statutory authority whose functions are to monitor, protect and promote human rights in Australia. The Commission has played a key role in the education of civil society in regard to these rights.

1. The Human Rights and Equal Opportunity Commission (the Commission) welcomes the opportunity to make this submission to the Senate Finance and Public Administration Committee on the Electoral and Referendum Amendment (Electoral Integrity and Other Measures) Bill 2005 (the Bill).

Recommendation 1: That item 13 of the Bill be amended by inserting a second note after new s 60B(4) that reads ‘the Act be interpreted consistently with Australia’s obligations under the Convention on the Elimination of all forms of Discrimination against Women and the Convention on the Rights of Persons with Disabilities, wherever relevant’.
