Human Rights 21: From the bench: landmark human rights cases
Why do I love HREOC? Well, I was there at the birth. I watched the Commission grow and accept new challenges every year. Australians used to be blind to the inequalities of women, to injustice to Aboriginals and other indigenous peoples, to Asian Australians, to gays and other sexual minorities, to people with disabilities and many others. If our eyes have been opened, we should be grateful to HREOC. In a real sense, it has been a conscience of our country: speaking out when others were silent. The Hon. Justice Michael Kirby AC CMG, Justice of the High Court of Australia -

Commission Submission - Access for All Alliance v Hervey Bay City Council
1. The present application does not specify the sections of the Disability Discrimination Act 1992 (Cth) (‘the DDA’) relied upon in making out the claim of unlawful discrimination. The Acting Disability Discrimination Commissioner (‘the Commissioner’) makes these general submissions on the assumption that the applicant characterises the alleged discrimination as indirect discrimination (as defined by s 6) in the manner in which access to premises is provided by the respondent (as made unlawful by s 23). -

Human rights for people with intellectual disabilities in Australia: where to from here?
I will not speak in detail about human rights conventions and disability because this topic is addressed by my co-speaker in this session, Karl Lachwitz. I will say though that international human rights law and human rights debate has not yet acknowledged adequately or sufficiently clearly that people with a disability are part of what the "human" in human rights means. Equally, there has not always been enough attention to human rights dimensions in disability discourse. -

Law Society Journal 2009: What will constitute a legitimate interference with rights?
A recent decision of the full Federal Court in Bropho v State of Western Australia[1] has created the opportunity to reconsider the operation of s 10 of the Racial Discrimination Act 1975 (Cth). Section 10(1) of the RDA is unique in discrimination law around the country. It is concerned with the operation and effect of laws rather than with making the actions of individuals unlawful. -
