1. In my evidence before the Commission on Friday 31 May 2002 I noted that the number of children in refugee detention centres in Australia had fallen from 582 to 184 over the past 6 months but that 351 children remained in detention on Nauru and Manus Island as part of the ‘Pacific Solution’. -

The aim of this submission is to inform HREOC, at the outset of its Inquiry, of the concerns held about Children in Immigration in Detention, by members of the legal profession in New South Wales. The focus of the submission is limited to the issue of compliance with international and domestic legal obligations. Relevant obligations are outlined, concerns are highlighted and finally, recommendations to address those concerns are listed. The Law Society welcomes any future opportunity to address any specific matters in greater detail at the request of HREOC. -

The ultimate conclusion that the Commission has reached in the submission is that the Commonwealth government's response to the recommendations of Bringing them home to date has been inadequate and inappropriate. The Commission particularly notes that the government's submission to this inquiry constitutes a fresh response to many of the recommendations of Bringing them home, which rejects several recommendations of the report on the basis of flawed arguments and poor reasoning.
