Pathways to Protection: A human rights-based response to the flight of asylum seekers by sea
President’s introduction Australia’s policy of sending asylum seekers and refugees to Nauru and Papua New Guinea’s Manus Island for processing of their claims has been one of the most contentious aspects of Australia’s migration policies. Introduced in 2012, third country processing has been a key plank of successive Australian governments to deter asylum seekers from travelling to Australia by sea. An age of uncertainty - Inquiry into the treatment of individuals suspected of people smuggling offences who say that they are children
This report makes disturbing reading. It documents numerous breaches by Australia of both the Convention on the Rights of the Child and the International Covenant on Civil and Political Rights. As a nation that is understandably anxious that the rights of our own children should be respected when they come into contact with the authorities of other countries, it is troubling that between late 2008 and late 2011 Australian authorities apparently gave little weight to the rights of this cohort of young Indonesians. -

On 13 August 2012 the Australian Government reintroduced a system of third country processing for asylum seekers who arrive by boat without a valid visa. Under this system these asylum seekers, including children, must be transferred to a third country as soon as is reasonably practicable, unless the Minister for Immigration decides to exclude them from transfer. -

The legislation in every Australian jurisdiction breaches the standards prescribed in the UN Principles in a number of ways. In some jurisdictions these breaches constitute fundamental violations of basic human rights. -

The Australian manufacturing and retail sectors and human rights
The corporate responsibility to respect human rights is a social responsibility over and above compliance with applicable laws. It is the minimum expectation society has of business conduct in relation to human rights. It means that as business goes about its business, it should not infringe on the rights of others. So manufacture your mouse traps, deliver whatever services you provide, but don’t ... -

Use of force in immigration detention facilities
The Migration Amendment (Maintaining the Good Order of Immigration Detention Facilities) Bill 2015 (the Bill) would give increased power to ‘authorised officers’ to use force against people (including asylum seekers) in immigration detention facilities. It appears that the majority (if not all) of the authorised officers will be employees of Serco Australia Pty Ltd (Serco), the private company contracted by the Department of Immigration and Border Protection to run Australia’s immigration detention facilities. -
