Discrimination: Any distinction, exclusion, restriction or preference made on a particular basis such as race, religion, national origin which has the purpose or effect of denying recognition, enjoyment, or exercise, on an equal footing, of human rights and freedoms in society.

The following hypothetical case studies present a number of scenarios where you can examine the potential legal rights and the legal responsibilities applicable to both employees and employers in the workplace.

The customer comes first; if the customers are unhappy, they will not return. My business will go broke, and we will lose our jobs. So we have to keep the customers happy.

2. We all have identities that are significant to us; identities that have an impact on what we think and do. This is true at school, at home and at work.

The DVD/script has focused on the workplace. But human rights situations involving identity and difference' can occur anywhere. There may be situations in your own life at the moment - at school, in a sporting team, at a social club, or with your friends - where you see that identity or difference is dealt with inappropriately.

To help your school celebrate International Human Rights Day, here are some suggestions that you could consider taking to the person or group responsible for planning the occasion – or you could volunteer to be part of the group and help:

Write down next to each statement the people that are responsible for protecting each of the rights. For example: is it you, your parents, your teacher, the police or perhaps the government?

Indigenous health - Programs for addressing Indigenous health reveal the problem of a lack of implementation of human rights. The National Aboriginal Health Strategy (1989) and the current National Strategic Framework for Aboriginal and Torres Strait Islander Health have been agreed by the Commonwealth with States and Territories. Both documents identify, from a human rights perspective, the key issues that must be addressed to improve Indigenous health and yet they have made very little difference to the problem (pp5-6).

Before the start of the war there were a number of countries, particularly Germany and Japan, which were dictatorships – countries in which the people had no say over the government. Those governments were both expansionist – that is, they wanted to expand their own territories by taking over other countries by force – and they were both ruthless in their treatment of those who disagreed with them.

Some of these principles relate to civil and political rights which defend the fundamental right to life, and states that no one can be tortured, enslaved, arbitrarily imprisoned, made to do forced labour, or be restricted from such basic freedoms as movement, expression and association. Such principles are stated in negative terms such as ‘freedom from’ (discrimination, torture etc).

The decision about what career path to follow is incredibly important. In the past, many people were limited when choosing their careers because of their difference, especially if the career choice was unconventional or not stereotypical. Today people have a right to choose their own career path, though there are often still some obstacles and barriers that are faced.

Education In 2002, Aboriginal and Torres Strait Islander people were less than half as likely as a non-Indigenous people to have completed a post-secondary qualification of certificate level 3 or above (that is post-graduate degree, graduate diploma or certificate, bachelor degree, advanced diploma, diploma and certificate levels 3 and 4).[1] Nationally in 2004, Aboriginal and Torres Strait Islander students were half as likely to continue to year 12 as non-Indigenous students.[2]
